You must be at least 18 years old and legally able to enter into a contract to place an order.
These terms should be read together with our Shipping Policy, Refund and Returns Policy and Privacy Policy, which form part of your agreement with us. 4. Our products are food, not medicine
Everything we sell is food. Our products are not medicines and they are not therapeutic goods. Nothing on this website is intended as a claim that any product prevents, treats or cures any illness or condition, and we do not provide dosage instructions or serving directions for a health purpose. If you see anything on our site that reads otherwise, please tell us and we will correct it.
Product information on this site is provided for general interest only. It is not health advice and it is not a substitute for advice from a qualified health professional.
5. Important product warnings
Honey and infants. Honey is not suitable for infants under 12 months of age. This applies to the Propolis Manuka Honey 829+, the Propolis Manuka Honey Signature Series 1650+, the Manuka Lozenges, the Manuka Honey Candy, and also to the Native Bee Propolis Extract, because the extract contains Manuka honey.
Native Bee Propolis Extract, children under 6. The pack states that this product is not to be used in children under 6 years of age. Please follow the warning on the pack.
Propolis allergen advisory. Products containing propolis may cause allergic reactions in some people. Propolis is present in the Propolis Manuka Honey 829+, the Propolis Manuka Honey Signature Series 1650+, the Native Bee Propolis Extract, the Manuka Lozenges and the Manuka Honey Candy. If you are allergic to bee products, pollen or propolis, do not consume these products.
Soy allergen. The Native Bee Propolis Extract contains soy, in the form of soy lecithin. If you are allergic to soy, do not consume this product. Soy is not present in any of our other five products.
Xotic+ Organic Lion's Mane Extract. This product contains BioPerine black pepper extract (Piper nigrum). If you are sensitive to black pepper or piperine, please check the ingredient list before you buy.
Allergies and suitability. Please read the full ingredient list on the product page and on the pack before you buy, and check it against any allergy or intolerance you have. If you are unsure whether a food is suitable for you, check with your doctor or pharmacist.
Storage and use. Please follow the storage instructions and the best before or use by date on the pack.
6. Orders and when a contract is formed
When you place an order, you are making an offer to buy from us. Payment is taken at that point, and our platform (Shopify) automatically sends you an order confirmation email. That automatic email is an acknowledgement that we have received your order and your payment. It is not our acceptance of your order.
A contract between you and us is formed only when we dispatch the goods to you, and it covers only the goods actually dispatched. If we dispatch part of your order, a contract is formed for that part only, and the rest of your order remains an offer we have not yet accepted.
We may decline an order or any part of it before dispatch. If we do, we will refund you in full for the part we do not supply, using the same payment method you used.
7. When we may cancel an order
We may cancel an order, in whole or in part, at any time before dispatch, in the following circumstances only:
- the goods are out of stock or otherwise unavailable;
- there is an obvious error in the price or the description of the product, and the error would have been apparent to a reasonable buyer;
- we cannot lawfully supply the goods to your delivery address, or the carrier will not carry them there;
- you have not given us information we need in order to ship your order, such as a valid Personal Customs Clearance Code for South Korea, and you have not supplied it after we have asked you for it;
- your payment is declined, reversed or not received in full; or
- we have reasonable grounds, based on specific information available to us, to believe that the order is fraudulent, or that the payment method has been used without the account holder's authority.
Where we cancel on the last ground, we will tell you that we have done so, give you a reasonable opportunity to verify the order before we treat the cancellation as final, and refund the full amount you paid. We will not cancel an order on that ground on the basis of a general suspicion, an automated risk score alone, or the country you are ordering from.
If we cancel, we refund what you paid. Nothing in this section limits your rights under the Australian Consumer Law or under the consumer law of your own country.
8. Your obligations when ordering
You must give us accurate and complete delivery and contact details, and any information required by customs in your country. In particular:
- South Korea: a valid Personal Customs Clearance Code (PCCC, the letter P followed by 12 digits) in the recipient's own name is mandatory. We collect this in the cart. Please do not send orders to a purchase agent, freight forwarder or reshipping service, because doing so can remove the personal import treatment that applies to food sent directly to you.
- Taiwan: the consignee name must match the name on the recipient's Taiwanese identification, and the recipient must complete EZ WAY real name verification when prompted, or the parcel will be held by customs.
If a parcel is delayed, held, returned or destroyed because the information given to us was wrong or incomplete, or because a required verification step was not completed, we are not able to recover the parcel or its value for you. Our Shipping Policy and Refund and Returns Policy explain what happens in that situation. Nothing in this section limits your rights under the consumer law of your own country, or under the Australian Consumer Law where it applies.
9. Prices and payment
Prices are those shown on the product page at the time you order. We may change prices at any time, but a change will not affect an order we have already accepted.
Australian GST. The price shown on the product page is the price you pay. Where Australian GST applies to a product, it is included in that price. We do not add GST at checkout.
Import duties and taxes. Prices do not include import duty, import taxes, customs charges or handling fees in the destination country, unless the checkout expressly says they are included. Those charges are set by the destination country and are your responsibility. Our Shipping Policy sets out what is known about the thresholds and charges in each market.
Payment is taken at checkout through the payment methods shown at the time. We do not store your full card details.
10. Currency
Our base currency is Australian dollars. Prices for South Korea, Singapore and Taiwan are set in Korean won, Singapore dollars and New Taiwan dollars, as fixed prices in each of those currencies rather than as automatic conversions from Australian dollars. Refunds are issued in the currency you were charged in.
Your bank or card issuer may also apply its own conversion or international transaction fee, which we do not control and do not receive.
11. Delivery
We deliver to Australia, South Korea, Singapore and Taiwan. Delivery times, carriers, costs and customs information are set out in our Shipping Policy, which forms part of these terms.
Singapore orders are posted from Australia and are personal imports, so you are the importer of record for them.
Risk in the goods passes to you when the goods are delivered to the address you gave us, or to a person at that address, or to a collection point you nominated. Ownership passes to you when we have received payment in full.
12. Returns, refunds and your consumer rights
Our Refund and Returns Policy sets out how to make a return or a claim, and it forms part of these terms. Nothing in these terms or in that policy takes away rights the law of your own country gives you. The following sections set out the position in each of our markets. Where these terms and the Refund and Returns Policy differ, whichever gives you more applies.
12a. Australia
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
We do not impose any time limit on a claim that goods were faulty or not of acceptable quality. Please contact us with your order number and, where you can, photographs of the problem.
12b. South Korea
If you are a consumer in South Korea, the Act on Consumer Protection in Electronic Commerce gives you a right of withdrawal (청약철회). You may withdraw from the purchase within 7 days of receiving the goods, or within 7 days of receiving the written terms of the contract if you receive those later.
Where the goods are different from how they were advertised or from the terms of the contract, you may withdraw within three months of receiving them, or within thirty days of the day you became aware, or could reasonably have become aware, of the difference.
Under Article 17(2) of that Act, withdrawal may be refused in certain cases, including where the goods have been lost or damaged through your fault, where the value of the goods has markedly decreased because you have used or partly consumed them, and where the value has markedly decreased with the passage of time so that resale is difficult. We do not rely on those grounds. Korean law only allows a seller to rely on them where it has given the buyer the notice Korean law requires beforehand, and we do not give that notice, so your 7 day right of withdrawal applies in full, including to products that have been opened, used or partly consumed.
These limits do not apply where the goods are faulty, damaged in transit, or different from what was advertised or ordered. In those cases please contact us and we will resolve it.
12c. Taiwan
If you are a consumer in Taiwan, Article 19 of the Consumer Protection Act gives you the right to rescind a distance sales contract within 7 days of receiving the goods, without giving a reason and without paying any charge or price, unless the goods fall within one of the exceptions set by the Executive Yuan.
Those exceptions include goods that spoil easily, have a short shelf life or would expire around the time of rescission, goods made to your specifications, and personal hygiene goods that you have unsealed. An exception only applies where we told you about it before you bought and you agreed at that point.
We do not give that pre-sale notice and we do not ask you to acknowledge it, so we do not rely on any Article 19 exception. The 7 day right applies to Taiwanese orders in full, including to products that have been opened, and we will honour it.
12d. Singapore
If you are a consumer in Singapore, there is generally no statutory cooling off right for goods bought online. You do have protection under the Consumer Protection (Fair Trading) Act against unfair practices, and the "lemon law" provisions of that Act give you rights where goods do not conform to the contract at the time of delivery.
13. Using this website
You may use this website for your own personal purposes, and to place orders with us. You must not:
- use the site in a way that breaks the law, or that interferes with the site or with anyone else's use of it;
- attempt to gain unauthorised access to any part of the site, any account, or any system connected to it;
- scrape, harvest or systematically copy content, images or prices from the site, whether by hand or with automated tools; or
- present yourself as an authorised distributor, reseller or agent of ours, without our written agreement.
We try to keep the site accurate and available, but we do not promise that it will always be available, uninterrupted or free of errors. We may change, suspend or withdraw any part of the site, or any product, at any time.
14. Intellectual property
All content on this website, including text, photographs, illustrations, video, page design and logos, is owned by us or by our licensors and is protected by copyright and trade mark law.
"The Fine Food Commons" and "Xotic+" are our own brands, and the two are commonly owned. "John & Jill's" and "Nature's Gold" are registered trade marks of Honeybiz Australia Pty Ltd, which manufactures those products. We sell them as a distributor and claim no ownership of those marks.
You may view, download and print pages from the site for your own personal use. Any other use, including copying, republishing, adapting or using our content or brand names commercially, requires our written permission.
If you send us reviews, photographs, comments or other material, you keep ownership of it, and you give us permission to use, display and reproduce it in connection with our business, without payment, for as long as you leave it with us. If you ask us to stop using it, we will stop and remove it from our own channels within a reasonable time. Please do not send us anything you do not have the right to share.
15. Our liability
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited or excluded, including liability under the Australian Consumer Law.
Subject to that paragraph, and to the consumer rights described in section 12, we are not liable for loss that was not reasonably foreseeable at the time you ordered, and we are not liable for loss of profit, revenue or business where you bought the goods for a business purpose.
We are not responsible for delay or failure caused by something outside our reasonable control, including customs inspection or seizure, carrier disruption, natural events, or changes in import rules in the destination country. This does not affect your rights where the goods are faulty or were never delivered.
16. Privacy
How we collect, use and store your personal information is set out in our Privacy Policy. We rely on the small business exemption in the Privacy Act 1988 (Cth) and we have not opted in under section 6EA. Our Privacy Policy explains what that means for you.
17. Changes to these terms
We may update these terms from time to time, for example when our products, markets or legal obligations change. The version published on this page when you place your order is the version that applies to that order. Changes are not applied retrospectively to orders we have already accepted.
We will update the "Last updated" date at the top of this page whenever we make a change. Please read the terms again before you order.
18. Language
These terms are published in English, and may also be made available in Korean and Traditional Chinese for convenience. If there is any difference in meaning between versions, the English version governs. This does not affect any right you have under the consumer protection law of your own country, and it does not prevent you from relying on a translated version where the law of your country requires that.
19. Governing law
These terms are governed by the laws of Queensland, Australia, and the courts of Queensland have non exclusive jurisdiction over any dispute.
This does not remove the protection of any mandatory consumer law that applies in your own country. If you are a consumer in South Korea, Singapore or Taiwan, you keep the rights that the consumer law of your country gives you, and you may bring a claim in the courts of your own country where that country's law allows it.
20. If part of these terms does not apply
If any part of these terms is found to be unenforceable or does not apply to you, the rest of the terms continue to apply. Any part that would exclude, restrict or modify a consumer guarantee for an Australian consumer does not apply to that consumer.
21. Contact us
If you have a question about these terms, about an order, or about a product, please contact us at commons@thefinefood.com and include your order number where you have one.
